Charges Dropped Against Ohad Fisherman in Ongoing High-Profile Case
The State Attorney’s Office of Miami-Dade County has released a recent public statement that they are discontinuing the pressing of charges against a man named Ohad Fisherman. This is due to new evidence that has resurfaced, casting a substantial amount of doubt on his alleged participation in a sexual battery incident that transpired nearly nearly a decade ago. The case had been active for an extended period due to its high-profile nature, however, the introduction of new evidence has instigated a pivotal turn of events.
Fisherman was initially indicted with a single charge of sexual battery, where it was alleged that he had played a role in assisting two others, identified as Oren and Alon Alexander, in the assault of the victim. This serious accusation was met with strong rebuttal by the defendant, causing the case to drag on due to ongoing contention between both parties involved.
Following the charges being made public, the prosecuting team located an unexpected piece of social media evidence, which had been posted on the globally recognized networking platform, Facebook. This discovery cast a new light on the case, and propelled Ohad Fisherman’s defense case into a more positive direction.
This evidence consisted of footage showing Fisherman enjoying a boat ride along the peaceful Miami Beach’s Intracoastal Waterway. The video was reportedly taken during the sunset hours of New Year’s Eve in 2016, a timeframe that aligns closely with the reported time of the alleged criminal occurrence.
Notably, the video indicated that it was publicly shared approximately at 9 p.m., the same night of the alleged incident. This fact substantially corroborates Mr. Fisherman’s argument that he was preoccupied with other activities at the alleged time, thereby implying his non-involvement in the reported offense.
The weight of this recent evidence compelled the hand of the defense team, resulting in Fisherman progressing to formally file a Notice of Alibi on the second of July. This legal action asserted that Fisherman was on the aforementioned boat at the exact moment of the alleged criminal act.
The concept of presence at the scene of the crime had formed a fundamental basis of the prosecutor’s argument against Fisherman. As such, the alibi and its supporting evidence served to seriously compromise this argument, given its inability to be firmly dismissed.
In light of these recent developments, the prosecution determined that it may no longer be possible to conclusively prove beyond a reasonable doubt that Fisherman was involved in the crime. This conclusion arises due to the compelling nature of the alibi and its potential to undermine the prosecution’s ability to meet the required burden of proof for a conviction.
Therefore, it was announced that the charges against Fisherman would be dropped. This significant decision is reflective of the inherent need to maintain fair and just proceedings within the legal sphere, even in the face of serious, high-profile allegations.
However, it is highly important to note that this decision to discontinue charges is specifically limited to the case against Ohad Fisherman. Corresponding legal actions involving Oren and Alon Alexander, previously implicated with Fisherman in the alleged crime, have not been affected by this resolution.
