On Wednesday, an appeal was placed before the Supreme Court by the administration, this time seeking to protect Elon Musk’s Department of Government Efficiency from disclosing internal agency paperwork as part of a lawsuit filed by a nonprofit legal watchdog. Solicitor General D. John Sauer brought an urgent plea before the justices, seeking immediate suspension of the lower court’s directive that necessitated the agency to make the records public. The argument centered around the assumption of authority by the judge, considered an overreach by the appellate.

Sauer’s representation contended that the body in question has immunity from the Federal Freedom of Information Act, suggesting that the order pronounced by the lower court grossly breaches the balance and autonomies of power structures. The order obliges a presidential advisory board to acknowledge and respond to requests for records, thereby endangering the privately held advice, undermining its integrity and confidentiality.

The urgent plea is the most recent in a chain of filings before the Supreme Court, a pattern evolved since President Trump’s resumption of office. The Court has been summoned to address speedily an array of actions undertaken by the Trump administration.
